Imperfect Ben Stone

In The Reaper's Helper [#3]: Ben probably had his secretary call the opposing counsel to tell them about his conversation with Mike Logan so the guy would get off. - Debbie

In The Reaper's Helper [#3]: When that guy socked him in the jaw. I kept waiting for Ben to get up and knock the crud out of him. - Kat

In Kiss the Girls and Make Them Die [#4] Ben is able to convict the dashing young Ned Loomis, but on what evidence really??? It was all circumstantial and/or hearsay. Also, the testimony of his former girlfriend (about Ned choking her-which was never charged against him) will buy the young man an appeal which he'll surely win. - Elizabeth

In Everybody's Favorite Bagman [#6]: Paul and Ben are talking to Dr. Goldberg about Halsey's death. Paul starts to ask if there was a 'causative connection' between the loss of blood and Halsey's coronary. The Doctor cautions "Oh, Come on guys you don't want to ask me that! ... causative connection?" Ben jumps in and asks a series of questions that result in the Doctor agreeing that Halsey was alive a week ago and now after being slashed he's dead. Halsey had blocked arteries and they 'could' have been a factor in his death but Ben intentionally redirected the questioning so that the condition of Halsey's arteries was not considered as a factor in his death. - Debbie

In Everybody's Favorite Bagman [#6]: The underworld hit man turned informant gets killed in the restaurant. The man is wearing a wire and Ben and a group of Feds are watching from across the street. While not really Ben's fault, Ben had a hand in it. - Bridget

In By Hooker, By Crook [#7]: Ben took a manslaughter plea from the woman running the prostitution ring. Then the jury forewoman said she would have chosen to convict. - Jackie

In Out of the Half Light [#11]: When he tore out of Don Cragin's office, yelling, "You people are yanked off this case, as of now! This is no longer a police matter." - Cynthia, Mike and Debbie

In Torrents of Greed [#16]: Where Ben gets Harve Beigel killed, Masucci killed, and an informant killed and then turns to Adam at the Mayor's dinner and says, "I really didn't want it to turn out his way." - Pat

In "The Wages of Love" [#24]: A pacing Ben, uncertain whether he's made his case, decides to accept a plea bargain--and then, leaving court, overhears one of the jurors saying that in another 10 minutes, they'd have voted the defendant guilty. - DidiJ

In Asylum [#26]: At the end, Ben is hounding Olivet to see if she can get Lemonhead (Christian Tatum) in shape to testify. He's being very insensitive and "Un-Ben-Like" by trying to get her to say he's fit. Olivet reminds him that it was his last court appearance that likely sent him over the brink, and hinted that it was Ben's fault that he's in the mental hospital on drugs and in pain. Ben doesn't seem very concerned over it, despite the fact that he says "I understand." You get the feeling that he'd rather have Lemonhead testify and let the chips fall where they may. - Pat

In Misconception [#28]: When Stone can't get the couple for killing her unborn child, he tries them for conspiracy on the theory that, although their actions weren't illegal, they are guilty of conspiracy because they did not know that their actions were not illegal. He does this although he knows that the man was a disbarred attorney and the women was a legal secretary. Even Paul Robinette questions whether this is malicious prosecution. He gets the conviction although one wonders if that was more a result of the jury's disgust with the defendants rather than the merits of the case. - JS

In Renunciation[#31]: Ben knew the findings of the forensic report were not incriminating but implied to the boy, Roy Pack, that when the "forensics report arrives this afternoon" it would contain evidence which would implicate him in the murder. - Debbie

In Severance [#35]: Where Ben's ego gets in the way of his better judgment and he agrees to sever the cases of several defendants against the advice of Robinette and Adam. It works out okay, but just by accident. - Pat

In Intolerance [#42]: The girlfriend tells Ben that she say the truck with the mother and brother in and and also saw the license plate driving away from the scene. Ben goes with her testimony without checking it out. He says, "Yea, we don't usually exclude evidence that convicts." After hearing the testimony Phil and Mike approach Ben, telling him that the girl was lying. There was no license plate for her to see. Ben has to ask for a mis-trial. - Debbie

In Skin Deep [#45]: When the photographer was having an affair with one woman's daughter and the daughter killed him. They got some panties out of the mother's trash and matched DNA. On the basis of an 80 percent match, Ben was aggressively prosecuting the mother and then in some plot twist I forget, it was discovered the daughter did it, a near 100 percent match confirmed it. Ben had to do a complete turnaround, released the mother, took a plea that put the girl in a psychiatric hospital. - jackie

In "Skin Deep" [#45] Adam is so disgusted by the entire handling of the case that he makes a comment (which I can't recall to quote) that suggests the entire defense team have been bumbling fools--they arrested the wrong woman, on the basis of a pair of underpants--which turned out not to be hers; prior to that, (in prepping her ex-husband to testify against her), they failed to learn that there'd been a custody battle for the couple's child, thus limiting the credibility of his testimony. - DidiJ

Could this be the comment, Didi? Adam, "When did we turn this office over to the Marx Brothers?" and "... didn't check who's bloomers are who's." - Debbie

In Wedded Bliss [#49]: When Ben lost his temper and pounded his fists on his desk because a witness changed her testimony. - Debbie

In Prince of Darkness [#52]: When Ben threatened to release the hitman's girlfriend and hold a press conference to announce that they "have a new prosecution witness who will solidify our case." Adam asked him, "Would you have held a press conference?" Ben replied, " I'm glad I didn't have to decide." - Cynthia and Debbie

In Prince of Darkness [#52]: The time he is hoodwinked by the Colombian drug lords into being lenient with a shooter who claimed that the "Angel of Death" had shot his son. The episode ends with Paul asking "What about the little girl?", and Adam answering "An uncle picked her up at school." Ben slowly looks and and says, "She doesn't HAVE an uncle." - Cynthia

In Point of View [#53]:A copy of Dr. Olivet's conclusion -- that the defendant (Mary Kostrinski) was justified in shooting the victim (Tommy Duff) -- got stapled to the discovery materials and sent to defense attorney Lanie Stieglitz by mistake. Kostrinski's defense was one of self-defense against an alleged attempted rape by Duff. Stieglitz calls Olivet to the stand rather than her own expert, knowing that the D.A.'s psychiatrist's affirmation of the defense would be much more powerful than that of a defense expert. Adam Schiff sarcastically inquires about the mistake: "What are we running, the '62 Mets?" - Nathan

In Point of View [#53]: The defense attorney (Elaine Strich) has the case just about won and is about to call the defendant to testify as the coup de grace. Stone shows the attorney proof that the defendant received $30,000 before killing the victim. In the next scene, the defendant is forced to take a plea bargain when the defense attorney threatens to refuse to give a closing argument in her behalf. When the defendant reminds her attorney that she is supposed to represent her interests, Stone tells the defendant that attorney doesn't have to because of subornation of perjury laws. Actually, the possible subornation of perjury would only prevent the attorney from calling her client as a witness. It wouldn't prevent her from arguing the case further. One of the basic tenets of the American legal system is that all defendants, guilty as well as innocent, are entitled to a competent and vigorous defense. Stone got his plea bargain by persuading the defense attorney to withhold a vigorous defense. - JS

In Discord [# 69]: Ben tells Claire that she should request a transfer after he says he can't trust her. When they win the case, Ben tells Claire about a young Assistant D.A. who stapled an internal memo to a document that was sent to the defense, thus allowing the defense to win the case. Ben says, "I thought it was a career-ender ...but they gave me another chance!" - Kat and Debbie

In Profile [#70]: When Ben rants at Judge Lisa Pongracic because she let Arthur Tunny out on bail. If Claire hadn't stepped in, Ben could have been held in contempt of court! - Debbie

In American Dream [#74]: After Ben Stone loses the first case to Phillip Swann, Adam tells Ben, "You've been out-lawyered by an amateur!" - Steve

In American Dream [#74]: When Ben is retrying Phil Swann, the young buck that represents himself? Adam tells Ben his ego is getting in the way. Of course he recovers beautifully. - Susie

In Censure [#80]: Obviously, the time he refused to recuse Claire Kincaid from a case (when she had a VERY good reason for asking to be dismissed). If he had bothered to glance up from what he was reading, he would have seen that it wasn't a frivolous request! - Cynthia

In Old Friends[#88]: When he managed to coerce the woman who had unwittingly gotten involved with the Brighton Beach Russian Mafia into testifying. She said, "Mr. Stone, I made a bad financial decision. I don't deserve to die for it." She did, and he resigned. - Cynthia
